Tutor Listing Agreement

This Agreement governs the listing of independent tutors on the platform german-help.com (“Platform”). By checking the acceptance box on the tutor registration form, you (“Tutor”) confirm that you have read, understood, and agree to all terms below. Acceptance via checkbox constitutes a legally binding agreement equivalent to a written signature. The date, time, and IP address of your acceptance are recorded.

1. Independent Contractor Status

You are an independent, self-employed contractor. You are not an employee, agent, partner, or representative of the Platform Operator in any respect. You are solely responsible for your own tax obligations, social security contributions, professional licences (if applicable), and compliance with all laws governing your self-employed activity in your country of residence.

The Operator has no authority to direct, supervise, or control your work. You set your own prices, hours, and methods, unless you choose to follow the Platform’s suggested pricing format for display purposes.

2. What the Platform Provides

The Platform provides a free advertisement listing for your tutoring services. This is a publicity service only. The Operator does not:

• Guarantee any number of student enquiries or bookings
• Process payments on your behalf
• Provide student leads or manage your client relationships
• Provide legal, tax, or professional advice

3. Optional Tools

The Operator may, at their sole discretion and without any obligation, offer you access to booking tools (e.g., Cal.com) or video conferencing tools. Such access is a voluntary courtesy and may be withdrawn at any time without notice or liability. You are advised to maintain your own independent tools and infrastructure and may not rely on tools provided by the Operator.

4. Listing Content and License

You may submit a profile photo, a short video (maximum approx. 2 minutes), and descriptive text. By submitting content, you grant the Operator a non-exclusive, royalty-free, worldwide license to display, reproduce, and reformat that content on the Platform for as long as your listing remains active.

You confirm that:

• All submitted content is accurate and truthful
• You hold all necessary rights to the submitted photos, videos, and text
• No third party’s rights (copyright, image rights, data protection) are infringed
• The content does not violate any applicable law

Tutors may use a pseudonym or professional name for their public listing. However, the Tutor confirms that the contact details provided to the Operator (full legal name, address, email) are accurate and complete. The Operator will treat this information confidentially and will only disclose it if required by law or in the event of a dispute.

The Operator reserves the right to reject or remove any content at their sole discretion, including content of insufficient quality, misleading descriptions, or content that violates these terms or applicable law.

5. No Right to Listing

You have no right to a listing, to continued listing, or to the publication of any specific content. The Operator may suspend, modify, or permanently remove your listing at any time and for any reason, without prior notice and without compensation or liability.

6. Data Updates

You may request updates to your listing content by contacting info@german-help.com. The Operator will process reasonable requests within a reasonable timeframe. Excessive or repeated change requests may result in permanent removal of your listing. Requests for deletion of your personal data will be processed in accordance with the Platform’s Privacy Policy.

7. Pricing Display

If you charge on a per-50-minute basis, your price may be displayed on the Platform’s tutor overview pages. If you use a different pricing structure, your price may be omitted from overview pages to avoid confusion for students.

8. Trial Lessons

You are free to decide whether to offer a trial or introductory lesson to new students, and to set its price and format independently. The Operator makes no representations to students about trial lessons offered by listed tutors.

9. Conduct and Content Standards

You agree not to:

• Provide false, misleading, or exaggerated information in your listing
• Offer services that are illegal in your jurisdiction or the student’s jurisdiction
• Use the Platform to advertise services unrelated to education or tutoring
• Contact students obtained through the Platform for purposes other than tutoring
• Defame, harass, or discriminate against students or other tutors

10. Liability

You accept full responsibility for your tutoring services. The Operator is not liable for any harm, loss, dispute, or claim arising from your interactions with students. You agree to indemnify and hold harmless the Operator from any claims arising from your services or conduct.

11. Governing Law

This Agreement is governed by the laws of the Republic of Paraguay. Disputes shall be subject to the courts of Encarnación, Paraguay.

12. Changes to this Agreement

The Operator may update these terms with fifteen (15) days’ notice via email or on the Platform. Continued use of the listing after the effective date constitutes acceptance.
